These Terms of Use apply to the public website at spacerun.app, its waitlist, and its download directory, operated by Spacerun, Inc (“Spacerun”, “we”, “us”). By using the website or submitting a waitlist request, you agree to these terms to the extent permitted by applicable law. If you do not agree, stop using the website. Nothing in these terms removes rights or remedies that cannot lawfully be excluded.

1. Scope and eligibility

The website provides information about Spacerun, a way to request access, and links to client software. These terms govern those website activities. They do not create a paid subscription or replace additional terms presented for accounts, applications, testing programmes, or cloud gaming services.

You must have the legal capacity to agree to these terms. If you need a parent or guardian’s agreement under local law, obtain it before submitting personal information. Do not join the waitlist if you are under 13. You must also meet any higher minimum age or parental authorisation requirement that applies where you live.

2. Waitlist and invitations

Joining the waitlist is free. Submit an email address you control and provide accurate information. Do not submit other people’s addresses without their permission or use the form to send unsolicited messages.

We may send an invitation and messages about your requested access. Your signup is stored in our invitation system, but joining does not itself complete account registration, purchase a subscription, or guarantee access.

Access may depend on capacity, region, device compatibility, testing needs, and other eligibility conditions communicated when access is offered. Joining, receiving an invitation, or referring another person does not guarantee a launch date, queue position, reward, game, feature, or level of performance unless we expressly offer it under separate terms.

You can ask to leave the waitlist by emailing support@spacerun.app. Our Privacy Policy explains how we handle signup information.

3. Product information and pricing

The website may describe planned features, supported games, indicative prices, subscription plans, or credit allowances. Offerings may change before they become available. Descriptions of maximum resolution, frame rate, or other performance depend on device, connection, region, game support, and available capacity.

The waitlist form does not collect payment or authorise recurring billing. Before any purchase, the applicable price, taxes, billing period, renewal and cancellation conditions, refund rights, and service terms must be presented for your agreement. A waitlist signup does not accept future charges. These terms do not limit rights arising from a separate purchase or from applicable consumer law.

4. Acceptable use

You may use the website for its intended lawful purposes. You must not:

• Attempt unauthorised access to systems, accounts, or non-public information.
• Distribute malware, interfere with the website, or intentionally overload infrastructure.
• Bypass security checks or rate limits, automate abusive signups, or send spam.
• Impersonate others, submit misleading information, or infringe another person’s rights.
• Copy or commercially redistribute protected website content without permission or another lawful basis.

These restrictions do not remove uses permitted by applicable law. We may block abusive traffic or suspend access where reasonably necessary to protect the website, enforce these terms, or meet legal obligations.

5. Content, games, and intellectual property

Spacerun or its licensors own the website’s branding, design, text, and other protected material. You may view the website and use its public features for their intended purposes. No ownership of our intellectual property transfers to you.

Game names, artwork, publisher logos, and other third-party materials belong to their respective owners. Their appearance does not by itself grant you a game licence or guarantee a partnership, endorsement, or availability. Any game or third-party platform you later use may require a separate account, purchase, licence, and acceptance of its provider’s terms.

You retain rights in messages and feedback you send us. You permit us to use that feedback to respond to you and improve the website and our services, subject to our Privacy Policy and any separate confidentiality agreement.

6. Downloads and third-party services

Our download directory may link to files hosted on ReleaseDesk or to Apple TestFlight. Installation and use may be subject to application licence terms, testing conditions, system requirements, and the relevant provider’s terms. Obtain software through the official links and review the terms presented before installation or use.

External websites, social platforms, and third-party services operate under their own terms and privacy notices. Their availability and content are outside our control. The Cloudflare Turnstile section of our Privacy Policy describes the bot protection used on this website.

7. Availability and responsibility

We take reasonable care in operating the website but do not promise uninterrupted access, error-free information, or compatibility with every browser or device. We may update the website, correct errors, or pause features for maintenance, security, or operational reasons.

To the extent permitted by law, the public website and waitlist are provided on an “as available” basis without additional warranties. We are not responsible for losses that were not reasonably foreseeable, or for business losses arising from use of this consumer-facing website, to the extent such exclusions are lawful.

Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where that liability cannot be excluded, or any other responsibility or consumer remedy that applicable law does not allow us to exclude or limit.

8. Privacy and security

Our Privacy Policy, including its sections on cookies and browser storage and Cloudflare Turnstile, explains our handling of personal information and browser storage. A privacy notice explains processing; these terms do not replace any consent required for optional processing.

9. Changes to these terms

We may update these terms as the website develops. We will revise the date above and give additional notice where required by law. Changes apply prospectively and do not remove accrued rights. Where your agreement is required for a change, we will request it.

10. Governing law and disputes

These terms are governed by the laws of the State of Delaware, USA, except to the extent mandatory laws applicable to you provide otherwise. If you are a consumer, you retain any mandatory protections and rights to bring proceedings in your home jurisdiction that apply to you.

Please contact support@spacerun.app so we can try to resolve a concern. This does not prevent you from seeking a legal remedy or contacting a regulator. Where applicable law permits, disputes may be brought in a court with jurisdiction in Delaware; these terms do not impose mandatory arbitration or waive applicable consumer court rights.

11. General terms and contact

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a provision does not waive the right to enforce it later.
